defense for “driving too fast for conditions”?
Is ther a legal defense for “driving too fast for conditions” if you are driving slowly (25 mpf or less) and still are involved in a one car accident due to ice on the roads? Driving to work, slowly because it was snowing, the car hit an ice patch and slid off the road hitting an emabankment. A large rock in the ambankment caused the car to roll onto it’s side. No injuries, only car damage.
I have driven on roads like this and I have slid into a ditch or hit a divide only going 5 mph! How are you supposed to know how fast to drive under certain conditions? I found this link for you so you can see there is a defense out there for you, I would speak to an attorney if you decide to fight this… I know I would. Good Luck!
