Hip Hop Mixing Software
Copyright,Sampling Producer Kits Question?
If i make hip hop beats on Reason (music making software) and i use downloaded kits from other producers to use their claps, snares, kicks and certain sounds that come with the kit, do i still have to ask permission from those producers or can i copyright the new created song under my name and sell it?
Bonus Question: (10 points if you answer bonus) If I sample pieces of songs (actual portions this time)like Kanye West does, in my beats, do I still need to ask permission even if I’m just putting it on a mix tape, and I credit the artist of the songs I sample? (This means I’m not going to make any profit out of it)
I’m not personally familiar with Reason or the downloaded kits you’re referring to. However, the extent to which you can use the included copyrighted content will depend on the license included in the software. The license language will answer your question.
As to your second question, whether or not you give credit or make a profit has nothing to do with copyright. For example, let’s say I make unauthorized copies of a CD, label it with the artist, and give them away for free. This is still illegal even though I’ve credited the artist and make no profit.
The same applies to your mix tape. You’re still infringing on copyright by creating a mix tape with unauthorized music, irrespective of whether you give credit or make no profit. If you want to jump through all the legal hoops, then yes, you will need permission.
